Cận cảnh loạt dự án tự phát phân lô, bán nền ven Hà Nội
Nhiều mảnh đất thổ cư ở vùng ven Hà Nội được sàn giao dịch bất động sản gom rồi tự phân lô, bán nền tràn lan bất chấp các quy định về pháp luật.

Đường vào dự án Khu đất nền 34 lô Cổ Đông- Hoà Lạc (xã Cổ Đông, thị xã Sơn Tây, Hà Nội) luôn tấp nập các xe ô tô của nhân viên môi giới và nhà đầu tư.

Thửa đất được chia đôi bằng con đường mới vừa rải nhựa, đấu nối trực tiếp vào đường ngõ. Phần đất còn lại hai bên đường được chia thành hàng chục lô lớn nhỏ, ngăn nhau bằng những đường chỉ gạch ngang dọc.

Dự án gồm 34 lô đất diện tích từ 180m2 đến trên 200m2. Giá bán dao động 9 – 15,9 triệu đồng/m2. Trao đổi với PV Tiền Phong, ông Nguyễn Viết Đạt, Phó Chủ tịch UBND thị xã Sơn Tây cho biết, trên địa bàn xã không có dự án nào có tên Khu đất nền 34 Cổ Đông. Theo đó, đây đều là đất thổ cư trong dân do các nhóm người mua rồi tự phân lô bán cho nhà đầu tư. Theo đó, ông Đạt cũng cảnh báo người dân mua phải những lô đất này vì đây không phải dự án.

Vào cuối tuần, sàn giao dịch bất động sản WonHomes tổ chức các đoàn xe khách đưa khách xuống xem dự án.

Dù không có hạ tầng nhưng các lô đất vẫn thu hút khách nội thành Hà Nội xuống xem và đặt mua.

Theo lời quảng cáo của nhân viên môi giới tự nhận từ sàn Wonhomes, các lô đất tại dự án đã được bán hết. Giờ muốn mua lô đẹp phải trả tiền chênh từ 100- 200 triệu đồng/lô.

Để lấy lòng tin của khách bán những lô cuối, nhân viên môi giới liên tục gửi hình ảnh xác nhận đặt cọc của khách về dự án.

Ông Lê Hoàng Châu, Chủ tịch Hiệp hội Bất động sản TP.HCM cảnh báo, các dự án tự phát phân lô, bán nền cũng là một hình thức đầu tư, kinh doanh bất động sản nhưng được ngụy trang dưới lớp vỏ bọc sở hữu mang tên cá nhân nhằm mục đích lách những quy định của pháp luật liên quan đến Luật Đầu tư, Luật Kinh doanh bất động sản và các quy hoạch chi tiết, quy hoạch phân khu. Nếu là dự án chính thống, các nền đất phân lô phải được triển khai theo mô hình dự án nằm trong quy hoạch, được chính quyền địa phương chấp nhận, chủ đầu tư phải hoàn thành đầy đủ các nghĩa vụ tài chính, đồng thời đáp ứng các điều kiện khác theo quy định pháp luật về quy hoạch đô thị, xây dựng, phát triển đô thị, kinh doanh bất động sản và nhà ở.
Ngoài ra chủ đầu tư phải hoàn thành việc đầu tư xây dựng kết cấu hạ tầng gồm các công trình dịch vụ, công trình hạ tầng kỹ thuật, hạ tầng xã hội theo quy hoạch chi tiết xây dựng 1/500 đã được phê duyệt, đảm bảo kết nối với hệ thống hạ tầng chung của khu vực trước khi thực hiện việc chuyển nhượng quyền sử dụng đất cho người dân tự xây dựng nhà ở”.
